Got into Accident

Got into Accident

I got into an accident this afternoon, the old asian man behind me claimed he thought I was going through an orange light but I braked and he clearly sped up even though I was slowing down. He admitted it was his fault. He hit me hard, but there wasnt that much damage for me, it looks like the left side of the bumper is torn and some paint marks and and indent. So I exchanged insurance, should i even go to the insurance company or do I just buy a new bumper? I never been in an accident before, i am not sure what to do, or if he will say its my fault.

Well there can be more damage under the bumper if he hit you hard. Did you report the accident to the police? If not do it asap and if he says he rear ended you and assumed fault then there will no problems going through insurance but if you didnt report it the guy can change his story and you can be at fault

you report it to a collision reporting center, not the police.

you may need to pay your deductible.

I would have reported it to the cops immediately, filed a report at the collision centre.

Let insurance do they rest. You may have to pay your deductible (As stated above), but everything should be covered under insurance. You are paying your insurance monthly, might as well use it. You were stopped, and he rear ended you. Its his fault, and he, himself, admitted it.

Make sure your ok; get checked out. Its better to be safe then sorry.

Reckless asian lady ran into me going ~70 last year, I was fully stopped, there was tonnes of damage to the car (it ended being a write off), as well as my knee/back. She got charged with reckless driving, and 6 points.

If you don't want to go through insurance, get a quote, show the guy the quote. Get cash from him, call it a day.

He may ask you to sign stuff, stating that this claim has been sorted out, and you, the driver, will NOT be going through insurance. (This is if he's smart, and wants to cover his *** about the claim.)


[This can't be the case, since you have already exchanged insurance information. Normally this second scenario works, if you are not sharing insurance information.]

If he already has your insurance papers, you better go through insurance.
Your making payments monthly to your insurance, may as well use it.


If the cops were called to the scene, you will eliminate the he said she said B$ that may occur later on.

Well no I didnt report it to police, and I never got any witnesses, stupid on my part. He refused to give me his phone number so I cant get a hold of him inorder to sort this out, all I have is his name insurance and policy number. My car looks only damaged at the left side of the bumper. There is a metal bar piercing thru the middle of the bumper, but I am not sure how much more damage there really is. So he has my insurance so i assume he will use it and claim its my fault. I think its too late to go to collision center, it happened yesterday around 6pm. I assume this will increase my rate, I'm only paying 171 a month.

So I should just go to a collision center and then contact my insurance company or his insurance company?

report it and file a claim...i filed a claim 2 weeks after the accident happened cuz I got quotes and the biatch said it was too expensive so I called up insurance and voila...they took care of it, since it was not my fault I was out nothing and my rates didnt increase

It's a rear-end collision. The driver in front assumes 0% fault, and the driver behind 100% deemed fault, regardless if charges were laid or not.

Go through the insurance. That way you get the car fixed properly and without argument about cost of repairs.

Because you are not deemed at any fault in the collision, you will not have to pay any deductible, nor will the claim impact your insurance rates.

Do what Marker said.

What I would do (as I have done in the past when I was at 0% fault)

- obtain the at-fault-driver's insurance information;
- file a report;
- call insurance company about the accident;
- go see a doctor;
- send the vehicle to the approved body shop either by the insurance company, or a shop you know of;
- get a rental vehicle if you need one.

Make sure you go see a doctor for this. Get necessary treatment(s) if required.

I did not file a report yet. I do not even know how to go about doing that or where it is. But I did contact my insurance broker and she did say there is a deductible of $500, I also got quotes from woodchester collision that the estimate is 1300 for a real honda bumper and 1100 for a replica bumper. and Mississauga Honda told me its 490 for bumper and 400 - 500 to put it on and repair and all. So I guess I will have to pay $500 and the insurance does the rest? And I guess it wont matter who I go to or does the insurance tell me what place to go to for repairs?

You can basically go anywhere to get your car repaired. But most insurance companies have set up a "reputable account" with some ma & pa body shop so they don't have to fork over more money to repair your car than they have to, such as the Honda place you have stated above.

cops generally wont come if the cars are drivable and nobody is hurt or if there are charges that should be laid

my worry, is why wouldn't he have given you his phone #???

go to a collision reporting center. cuz if he already did, and has filed a different scenario than you are going to submit, it could become a he said/she said mess...

also, if he hit you, his insurance will cover the $500 deductable...

go report it to the collision center, call your ins company, and dont wait. you only have so long to report an accident before you are up **** creek without any options what so ever. there is a time limit in these situations!
