Got a bs ticket....

Ok here's the story,


I was driving down barton street between green and millen and it is 60 km. Me and my friend were driving and then a truck trainee was going really slow (like 40) so we passed him. I am behind my friend the whole time. I was going about 70 to pass him (in order to get infront of other cars). We both get into the other lane and keep the constant speed. I'm in 4th gear rev'ing at 3,000rpm. Which is 70km/h. On barton street there is a school which changes the speed limit to 50km which I was unaware of. So me and my friend are still driving going about 70. I am behind him the whole time. I then back off a bit going 70 but I think he is going a little faster. So then, a cop ends up pulling him over, me thinking i'm not getting pulled over because I wasn't really speeding. But then he ends up waving me in there as well. So, I go in, he goes to talk to my buddy first and says he was going 80km in a school zone 50. He asks for all his information (drivers licnese, etc.) and takes it with him. He then comes over to my car and asks "you and your friend having some fun street racing?" "i replied, no, I dont do that, i'm trying to get back to school" "he says, ok....can I have your drivers license, etc." I give it to him and he walks back to his car. He then comes back 15mins later with a ticket for 86 in a 50. I seen this ticket and flipped. I got outside my car and went to the cop to see the radar. He said sure go up to it and look at it. I went and looked and seen 86km. I then walked back to him and asked, well who did you clock going 86. He said my buddy. I replied, well what did you clock me at ? He said I was going the same speed, I then asked well, how do you know how fast I was going, he didn't reply. He kept on writing something else down. My buddy then asked when the gun was last collaberted, he said he doesn't know when but its all documented, buddy asked can he see it, he said he doesn't have it. We continued to asked some questions but he didn't give any answers so I just left.

My questions are:

Can he pull over 2 people at once ?
How can he give me a ticket without clocking me ?
He didn't explain why he pulled me over, is this ok ?
He didn't reduce it at all....
How much will this effect my insurance?


He didn't make any errors on the ticket. So that is out of the question. He gave me and my friend the EXACT same ticket. PLEASE GIVE ME SOME INPUT....

What about not seeing the radar gun and him not radaring me...

Is there an "R" at the bottom of the ticket? If not, you may be able to get it reduced by a JP.

If there is an "R", that means that the police officer has reduced the fine on the spot. Which means that when you go to fight the ticket, and speak with a JP, they see this "R" which leaves little or no room for further reduction...

the officer did nothing wrong. if he clocked your friend at a certain speed its easier to tell if you were doing roughly the same speed.
looks like your **** out of luck with that
fight it though, maybe he won't show up or read that how to beat the radar sticky here to prepare yourself

hey, atleast the school zone was only a 50kmh zone and not 40...but yea if u were behind your buddy goin 86 you musta been goin somewhat the same speed...its the pace principal

I was like 4-5 car lengths behind him, he was speeding up, we just passed a truck that was a trainee. I wasn't even going CLOSE to his speed. Like not fast at all. I admit prolly 70, but not a chance in hell was I going 86 ! That what i'm trying to say !

ok now let me explain that comment here you are trying to use court arguments like when was the radar last calibrated and stuff .. and you got out of your car .. thats a big no no your just lucky he didn't put you over his hood ....

a cops job is to write tickets not judge you thats what court is for ... all that information you asked him will be disclosed to you once you ask the prosecution for full disclosure...

a cop can judge your speed based on whatever he wants ... hell he could use carrier pigeons if he wanted too ...

as for the last comment of course he could be clocking you 2 km's away ... radar is like that allows for speed measurements from far away hell in some line of slight ain't needed....


asking when the radar gun was calibrated is like asking when you last chad your speedometer checked and calibrated I bet yours is off by that much ... how's this try driving without passing anyone... then you know your not going fast enough for a ticket ....

tell that to the judge, the fact remains that you have a ticket and arguing whether he clocked you, or when his radar was calibrated with people on this forum isnt going to get you anywhere.

face it, if you werent speeding, you woudlnt have been caught.. but the fact is that you made a conscious choice to speed and you happened to get caught, and now you have a ticket, which you deserve

WHAT YOU DON"T UNDERSTAND IS HE DOESN'T HAVE TOO

he can tell the judge he clocked car one and car 2 appeared to be following at the same rate of speed ..... thats good enough for a conviction .... if in his opinion you were following at what appeared to be the same rate of speed your screwed.... period ...

given the circumstances.......

be thankfull he didn't nail you and your buddy for streetracing

huge fine plus 6 or 7 points.

you have 2 options now..

- go to a justice of the peace, tell them what happened....... and you're almost gauranteed to have the fine reduced.

- fight it in court....... but then its a 50/50 chance..... some judges will be nice, some won't



if you can afford it, get a traffic lawyer.... it will save your insurance.

Here's how his evidence will go.

He will say that he observed two cars coming down the street at excessively high speed after having rapidly passed a truck in tandem.

He will say that the cars were in close proximity to each other and appeared, based on his experience and training, to be travelling the same speed.

He will say that radar indicated a speed of 86km per hour, in a 50 km school zone, and that teh radar reading confirmed his visual aproximation of the vehicle speeds.

He will say that when stopped, the two drivers indicated that they knew each other and were friends.

Then the judge will look at you and mutter under his breath that the two of you should have been charged with street racing. And maybe you should have.

But by all means, go on into court and try to fight that ticket. There are few things more effective than public humiliation when it comes to curbing poor behaviour, driving or otherwise.

and the words "school zone" have you by the short and curlies...judges have no leniency for that

The only thing that you have to go on is to explain the situation to the judge. The cop himself changed his mind on what speed you were going while you were standing there if he said 80 and gave you a ticket for 86. He did not get you on radar and combined with his indecision on what speed you were actually going it is conceivable that you can convince a judge that you weren't doing anything near that. The only problem is that the judge might not care since you were in a school zone and you aren't going to convince him that you were doing the speed limit. The fact that the other guy was your buddy doesn't mean that there is an invisible tow hook between your cars so the fact is that the cop just guessed at your speed and assigned the number that your buddy produced on the radar to you. This is sloppy work and complete bull****, as you mentioned. If I tried pulling that **** at work I'd be fired.

Steve , call these guys. They got the g/f's ticket for 139 in a 90 reduced from 4 points to 2. Based out of St. Catharines, but they do Hamilton too. You just have to fax them the ticket and we had to write a detailed explanation of what happened. They charged us $200 to represent her and they did all the work.
