good info RE: Muffler / Plate Covers
I had a court date to day to fight "plates not clearly visible" and the ever popular "Improper Muffler" charges.
I represented myself, but had a little bit of help from my friend, who works for Points, hes a traffic lawyer.
Anyhow, the officer showed up, and both charges were dropped. Heres what I did.
First off, use this forum. Its filled with great advice and also, check the links for the HTA, and familiarize yourself with the offence you are being charged with.
I reached the courtroom a half hour before the trial.
I suggest looking for the officer before the trial, and try to talk to him about your case. perhaps you can reach an agreement that will make the actual trial in front of the justice easier.
When entering the courtroom, approach the prosecutor, and present them with your information.
in my case, I had an Emissions Test, taken at Sisley Honda (where I purchased my vehicle) 2 weeks after the offence date, stating that my car was 100%.
That took care of the Exhaust charge.
secondly, I provided the prosecutor with a bill for the 407, clearly showing my plate number, and travel date, only 1 week after the charge. I explain that both issues have been corrected, and she proceeded to tell me that both charges would be dropped, to have a seat, and that we would take care of it in front of the justice.
a few cases go by, I get asked up, state my name, and the prosecutor states that both issues have been rectified, and asks that both charges get dropped. The Justice agrees, I ask to be excused, say thank you, and exit the court room. Victory!
I spoke to the officer outside, he was really nice, and very impressed at my preparation.
So my advice, do your research, look presentable, speak eloquently and politely, and you will be treated with respect and fairness. Hopefully this post can help you guys out a bit..
