Full disclosure request and Notice of Constitutional Question form
 

Anybody have a request for full disclosure letter and a Notice of Constitutional Question form that they've used that I can use as a guideline for making mine

Offense date was September 2007 and trial is March 2009 for by-law section 132933A. It was driving in the car pool/diamond lane by myself during prohibited hours

The fine isn't a big deal but an insurance broker told me my insurance will still go up

I'd like to know the same and how can I contest to this form of ticket as I was trying to take an exit(Driving in the right extreme lane ~ which was also supposed to be a car pool/diamond lane)..??

I was not intentionally driving in the lane as I was looking to take an exit..? An urgent/immediate reply/response would help me a lot as the trail date is in a few days..(a week) coming up soon.

Your car insurance broker is mistaken, or he or she assumed you were charged under the HTA as you would be if you were caught on the 403 or 404 car pool lanes by the OPP.

The city of Toronto HOV lanes are different in that both HTA and local bylaws govern their use. You can be charged under either local bylaws, HTA, or both.

In your case, you were charged under the city bylaw, so the offence is like a parking ticket. It does not go on your driving record, so there is no points or insurance hit.

I dont mean to thread jack, but how the hell are u supposed to make a right turn in those diamond lanes anways? Do they expect you to cut ppl off last min so u can merge w/o driving in the lane?

Pretty much. The law says that you can be in the HOV lane to make a turn no earlier than 45 meters from the intersection that you plan turn at. That is a distance of about 2 streetlight poles before an intersection.

"All drivers will see from the signs displayed that between the hours shown, usually rush hours 7:00 a.m. to 10:00 a.m., and 3:00 p.m. to 7:00 p.m., the HOV lanes are reserved for buses, bicycles, taxis, and vehicles that have three or more persons. As of last summer, motorcycles and scooters have been added to the list, and they too have now been identified on the signs. The only exceptions to these vehicles are those turning right onto the HOV street.

45m isn't much space by toronto standards to merge into a lane. It's doable, but i think it's totally askin for trouble in toronto traffic.
