Basically first attendance is a meet with the prosecutor . . to see if u can meet half way and strike a deal i.e. lesser fine and points....and if u both agree upon something.....u don't go to trial...if u disagree with the prosecutor and know u shouldn't have this ticket. . .then go ahead and go to trial. . .

no Mississauga...i wasn't legitimately speeding either...there was a sign posted 80 and then at one intersection light there is nothing and then after the light there is a 80 posted again...but i was pretty much following the flow of traffic...kinda...the traffic around me was goin faster then i was... and i was inbetween 2 trucks...out of all the ppl...i got pulled over!

HAHA so if there was 80 posted all around??...how'd u get a ticket for 90 in a 50??!?!?! where u caught "speeding" inbetween both these 80 signs?.....and what's the street written down on the ticket?......because if the street that'z written down inbetween the ticket is inbetween the two 80 signs and there are no other signs that say 50. . .ur free pretty much. . . take a drive and check that out.......take some pictures i guess of the street location and signs. . .on first attendance just tell the prosecutor ur story......if he doesn't believe u....just bust out the pictures. . lol and if he'z like no no i don't have time for this. . . say fine see u in court. . . represent urself...cause ur for sure gaurnteed to win...if there is no other sign around.
That'z probably one approach i guess. . .

You should probably take this to court unless the 2 speed limit signs that you are talking about are 5 km apart. Go to court with photos of the 2 speed limit signs and a detailed map of where they are and where you got the ticket. Tell the judge you drive on that street every day and the speed limit is posted as 80 along that stretch. If there was nothing to tell you that the speed limit changed then your ticket is BS.

No. The prosecutor can work something out with the fine but the points are determined by the charge. If you can talk them down to 15 over then you won't lose any points. This is doubtful though because I've never heard of anyone getting more than a 1 speeding level reduction. Since you have a 40 over, which is a 4 pointer, the prosecutor most likely will not reduce below a 3 point offence. The difference between those two tickets is negligible to your insurance company whereas they might not raise your rates for a 0 point offence.

Thats not true, I got stopped on the 407 doing 146 in a 100 zone, and the Prosecutor knocked it down to 15km over because it was a first time for me and I was completely honest about the whole thing.

If I were in your shoes I would go with the posted speed limit defence. Take some photos and present it to the judge. If you can show the officer was wrong about an important fact in his testimony then the rest of it is worthless if you spin it right since he's just reading off a piece of paper. See how many times you can ask the same question: "Are you sure about that? As sure as you were about the speed limit?".

I was nailed doing 117km/h in a 60km/h zone in my Bimmer.....Got off with no charge or points...seeing how the cop had wrote down wrong intersections where it was posted 80km/h so it ruined his credibility on that ticket...proscutor dropped all...so there is luck...I hope you have it!

The Prosecutors have a map of the City/Region in question which has every street's posted speed limit. I hope, for your sake, that you are VERY sure that there was no posted limit ... that might give you a very miniscule hope of beating the charge. Go back to the scene of the offence and clarify as to what the posted limit is.
The sad thing is that even if there was no posted limit, you will most likely be unsuccessful in your bid to beat the charge. You see, in s. 128(1)(b) of the Highway Traffic Act it essentially sets out the fact that you are not to drive greater than 50 km/h on a "city" road unless the posted limit is greater than that. In other words, if it's not posted you are to assume the limit is 50 km/h.
Hope that helps clairfy some things for you and good luck!
