dumb cop (i hope)

ok i need help
i live in burlington but got a ticket in toronto and on it the cop put my address as 6402 when it really is 5402
can i fight it
the ticket is only $52 but i really dont want to pay it. is it worth fighting

Take it to court...if there is an error on the ticket it gets thrown out as far as I know.

as long as the driver's license number is correct, they will just ammend the mistakes there in court...may i ask what was the $52 fine for? speeding?

did the officer reduce it for you? or is it a real 10 over case?

if it was reduced, you might as well pay the fine, cause once the officer tells the prosecutor that it's reduced, (s)he wont go any lower! you can always continue on to the judge, who might reduce it even furthur, who knows.

if it was an honest speeding case of 10 over, then the cop really must have been in a really really bad mood, cause that's just nuts of him!!

take it to the prosecutor, and im pretty sure that'll get dismissed!

i would but will my insurince go up and i dont know what i was doing bc it was late so i made a mistake and he made a mistake the only question is who will take the fall for it

Were you really doing only 10 over? If you were going faster consider yourself lucky and pay the ticket. If you were over the limit I say just pay the ticket, you aren't losing any points.

Dude, the address is a minor thing, it may **** the court off by you being petty (in their eyes) .

As long as you didn't get any points it shouldn't affect your insurance.

spelling mistakes are not a reason to cancel a ticket..
cops, believe it or not, are human too and are allowed to make errors..
so long as the license # is correct you be stuck with it..
i think the only thing that might save someone's *** is if the wrong violation is listed..

ie. he got you for speeding and wrote the act # for blue lights or sumthing along those lines..

and if you have more than 1 hit (ticket) it will affect your insurance rates, regardless if you've lost points or not..

Well I did get off one time because the cop wrote the wrong intersection.

Pretty lucky though, I was surprised it worked, it was pretty much my word against the cop, man he was pissed when i presented my case to the crown, you should have seen the death stare he gave me.

FIGHT IT!!!

If the cop was unable to COPY an address down properly... state that the officer was not necessarly competitant enough to judge your speed or read the speed off his speedgun. If he can confuse numbers.. he can confuse speed "NUMBERS"

Try it. He may take it personally cuz you've insulted him but hey.. it gets you off at least cuz he may not have been competitant enough to know your speed

i think i was doing around 75 but the cop said that if he hit me with what i was dong it would have been a $100 fine and 3 demerit points

Hey, you make a good point .
I never thought of it that way... "Oh 6402, 5402, numbers numbers, I can understand constable, it was late a night, you were tired, it was towards the end of your shift and you wanted to get home, mistaking 6402 and 5402 is much like mistaking 65 Km/h for 56 km/h now isn't it?"

Make sure that you don't tell anyone of the mistake at the bargaining time, then when it's your time to plead your case ask the constable to read your address because you can't make out his penmanship, (If the crown gives you a hard time, ask them to please humor you ask it aids to making your case) then when he reads "6402" ask him if he is sure, then present the lic you gave the constable that night to the crown.

Then say something to the effects of , "Your Worship, that is the lic I presented to Constable X and he managed to mistaken the NUMBER address for my home. He has also stated that he is SURE that my address is correct just like he is SURE about the numbers of the proposed speeding violation? You worship, I think it is safe to say that we cannot rely on the Constable's judgment when it comes to numbers that evening. If he can mistaken the 5 on my lic than he certianly could have mistaken a 6 on the speed gun for a 5."

Then run out of there and on the drive home, drive like a grandmother taking her driving test.

Oh yeah when in court, address people by their proper titles.

Makes you look more prepared and professional.

Cops are "Constable (insert name)" unless they have 3 cheverons, then they are a Sgt.

Judge: should be addressed as "Your Worship" (Not your Honour, Sir, Ma'am, Your Highness); they represent the Queen,

If the address is wrong it doesnt mean anything. They could spell your name wrong and it wont matter. It'll just get ammended in court.

The only thing that is critical on a ticket is the PRESENCE of your name and the charge.
