Driving charge, please help.

Driving charge, please help.

Hi everyone, just wanted some help/advice on a recent driving ticket that I just got. Let me explain the story.

I'm driving down a residential street, and stop at a 4 way stop, I admit, I didn't stop completely, but rolled by. Then at the end of the street, theres a intersection on to main road. Once I turn left, I floor the accelerator to see how my car runs with the new engine. I hit 120 KM/H, and then let off. The speed limit was 60 Km/H. I see in rear view a car coming up quick. In my head I was like "oh ****, please don't be a cop". And the next thing you know, its a cop. She pulls me over (I'm with 2 friends), and asks, "in a hurry some where, where are you going, license, ownership, insurance, blah, blah, blah. She also asks me if I had any charges, I tell her a seatbelt, vehicle off road not in safety, and failure to report damage. I tell her I don't think I have much demerit points left.

She comes back 10 mins later, and gives me a charge for failure to stop, rolling through a stopsign. I ask her how many demerit points this is, and will my insurance go up? She says that it was 2 demerit points, and insurance WON'T go up. So, I'm like okay, I'll pay the fine and shiet. Next day, I call this traffic lawyer, because I had some recent work done with them before, and I was kinda sketchy on the idea that insurance won't go up. Unfortunately, she tells me its 3 demirit points, and insurance will go up, and might even drop you with all your charges. They told me it was $300 bucks for them to fight it for me.

I don't have that money, and I want to fight it. I've also got my 2 friends that agreed to coming into court, and state that I stopped completely.

I'm looking for some advice and help on where to start, and things to say.

So far, I'm planning on pleaing not guilty, explain my story and asking for a disclosure.

My question is, if on the disclosure it says that I was going 120 Km/h on the 60, but the officer didn't charge me, could they give me another charge for speeeding?

What should I do? I've already contacted the driving lawyer. Any past experience or help is greatly appreciated. Thanks.

The ticket also says that there were no witnesses? If I were to go to court, could I use my 2 friends to my defense?

Your friends in the car won't carry any weight with a JP. They're not considered independent witnesses.

The only thing you'll accomplish by putting them up on the stand is to show them up to be liars.

But you yourself shoud feel free to go to court, swear an oath to tell the truth, and then lie your face off.

The cop will then also go up on the stand and outline the circumstances by which you got the fail to stop ticket, including your extremely excessive speeding. The JP will see you for what you are, and make a finding of guilt, and then maybe even make a point of telling the whole court how your story is complete fantasy.

In the meantime, any other London area cops in the courtroom will also see you perform on the stand, which will set you up real well for the next time you get stopped by any one of them.

So, are there any London area cops on the boards here to add their comments, and maybe chat with the London cop who issued the ticket to get her take on this?

So, let me get this straight, on the day of the trial, I'm waiting until my case gets brought up, when it does, I present myself to the judge, and rest of the courtroom. He asks me how I plea? Or does he first read the report of the police officer, then ask me how I plea. I'll tell him not guilty. Does he then ask me for my story? or side of what happened?

If he asks what happened, I'll tell him that on the day of the charge, I was driving on huron st, turning on to jensen road, it was a 4 way stop with stop signs, I was making a left, and there happened to be a car infront of me. The car came to a rolling stop, and turned left. I stopped completely as he was making the left turn. I then proceeded to turn left as it was my turn to go.

Would the judge then put the officer up on stand?

If I'm found guilty, would the Judge increase the charges (fines & demerit)

It would be one thing if you were actually innocent of having done anything wrong. In such cases you certainly should fight the ticket and there would be no moral issue involved in extending you advice and help.

But you've already admitted here, in a public forum, that you did in fact roll through the stop sign without coming to a complete stop. You've also already admitted here, in a public forum that anyone, even the cops and Crown and JPs in London, can read, that you and your friends plan on lying in court.

Do you known what perjury is?

Now you're trying to get advice so you can get up and lie in court. I'm not going to help you with that.

Not to mention his poor driving record lowers his credibility substantially. His word against the police officers and with a bad record, who will the judge believe. Maybe the judge will throw the speeding ticket back on to make it more interesting.

Though I firmly believe that going double the speed limit is a bad idea I don't believe anyone should roll over when they receive a ticket.

Your best bud is get that 300 dollars and fight it with a traffic court specialist and PRAY shyt gets dropped or reduced. Worse case scenario, you get hit for what you actually did wrong. A fact you've admitted to this forum.

I could say, DON'T speed but that would be an unreasonable expectation in your case. Best advice, if your going to rip at least do it on the highway, the ticket will much less, that is if you decided to stop at a 120.

They can't do that, the officer failed to do so at the time of the incident.

Yeah, I guess I'd better start saving.... They saved my *** before when I got the 2 worst charges in the Highway Traffic Act.

Yes they can if the officer has that speed recorded in his/her notes. Sometimes if you decide to fight the Reduced 10km/hr over ticket, but really you got pulled over for 40km/hr over. The judge depending on their mood, police statement, your past driving record, COULD change the speeding ticket to the higher speed, and the fine & Pts to go with it.

So sometimes it's not a good idea to fight the reduced ticket.

btw perjury (lying in court) is a criminal offense.

Back from the dead, just went to court and I had the ticket dropped. For those who are down about bull**** tickets, keep your head up.

that's awesome, but judging based on your story and your attitude about it, you will be back in court in no time.. hopefully no children will get hurt..
