Can I preform any Legal Action?
 
Ok so just this past week I was driving and my ball joint on my 93 Civic snapped. My wheel ended up flying off and because of this I snapped my axel and drive shaft. I bought the car Mid April from a dealership and he was supposed to get it "safetied". Ive got the car looked at by 2 licensed MTO safety people and they checked the ball joints stating that there is no way that they should of passed. The passenger one needed replacement forsure and the back two were "iffy" they said. I was driving at a decent rate of speed and almost got t-boned by a transport because of this. I am now without a vehicle and down right angry. My guess it was either a fake safety or the people that safetied it didnt take the time that the should of to check it over? Im just wondering what I can do because I hate being without a car and I dont really want to pay for the repairs because i was quoted minimum $1000 right now. Anyone know if there is anything I can do? I was thinking of going to the dealership with a lawyers letter and scaring him into thinking I was suing him and seeing if I could get a new car out of it. I dont know haha thats why I am asking you guys. Dont flame this thread either, i know nothing about law so I appologise for my "stupidity".

I might be right and might be wrong...but when they "SAFETY" your car....they check ur lights are all working...ur brakes are not worn...tires are in good shape and not bald...but I've never heard of them checking the ball joints?!?!

You said it's gonna cost you $1000 to fix the car..

how much do you think it's going to cost for a lawyer to draft up a letter for you?

Say a cheap lawyer at like $200/hr, to sit down meet with you write up a letter blah blah blah... you're lookin at easy $500... prolly more...

for a CHANCE at getting some of the money? which won't happen because the dealership wasn't at fault here... whoever did the safety was... so then you have to go after them.

Legal options are always fine... if you can afford them... IMO it's not worth it in this case

No new car...that's for sure

however find a lawyer who will do some pro-bono work (all lawyers are required to do that) and see if he'll take ur case and do it free of charge

but the dealership cannot be held liable for what happened...they can claim they sold car in working condition...maybe you did some mods to it which the car wasn't made for...and boom ur ball joint broke.....im giving u a hypothetical argument on behalf of the dealership...but it's possible they might play that card

Safety checks aren't a warranty. They're only valid for 30days from date of inspection.

I think you're out of luck. It's been too long since the safety. Only chance you have is to go to the dealership and complain like a mofo. Maybe they will give you a discount on repairs.

Thanks for the advice. Im aware about the safety checks but I figured that there might of been a loop hole like everything else. Again thank you for everyone who posted.

^^^^^yup, i had to change both front upper ball joints on the wifes car when we bought it, in order for it to pass a safety.

But unfortunately, the dealership will just say that the balljoints were ok when the car was safetied b/c ball joints do wear out over time.

if it happened WITHIN 36 DAYS of you getting the safety certificate something could have been done about it. now its too late.
