Can I get a ticket if the police was not there?
 
So I been searching this for a while now .. I ve read different takes on this and I had one officer tell me no it can not be done.. However there are people out there that claim they ve got it

Anyways lets say you beat a red light or you cut off someone and some other driver saw you doing it and wrote down your plate number... Could he go to the police station and report what he saw??? and if so , would you received a ticket in the mail for an infraction that someone else ( not a police officer) saw you doing

For example today i was coming back from toronto , a ttc driver was at the red light ( streetcar) , I was driving in the lane beside him , just as I m close to the front of the streetcar he decides to open his door ... It was too late for me to stop and noone was comming off the streetcar yet , so I just drove by and stop my car somewhat ahead of him ( 2 lanes , he is in the left and i m on the right) ... Of course the driver honks at me...

But if he decided to write down my plate number and report me could i get a ticket?? ... this is just an example , but there are many to list

anyways i m curious to know what the experts say

The Roadwatch program is built on the premise of citizens reporting aggressive or dangerous driving. There have been a few convictions based on witness testimony coming out of Roadwatch. As long as there is a witness willing to testify, the cop doesn't have to personally witness the incident.

It doesn't happen often though. For many HTA offences, getting a conviction is difficult if the driver cannot be positively identified, but for others, the owner of the vehicle can be held liable for the offence no matter who was driving at the time, so identifying the driver is less of an issue.

So let's say I spot street racing, go down to police station, I can get the people in sh!t?

What if I just don't like somebody and lie to just get the person in trouble, how would that work out?

thats what i m tryint to get at... I ve read about the watch program in another forum ..


So lets say i want to get someone in trouble and I get a "witness" who could be a friend who also wants to get the same person in trouble.. He could actually get a ticket for something he didnt do ?

I remember a taxi driver writing down my plate number because I cut him off , then again he was honking at me to turn right when ther e is people crossing the street !! damn taxi driver... Never actually got a ticket :D

I always thought if someone called it in to the police and a few months or years down the road someone else calls the police for what ever reason you did, do they keep a note on their system? Like if you keep cutting people off or going through red lights etc,. can the police give you a ticket and say that they've received numerous calls on the same plates? Thats how i thought it worked.

The same goes for any criminal or provincial offences act offence. If there are witnesses willing to perjure themselves when testifying against you in court, you could be screwed. On the other hand, if the cops find you filing a false report, you could be looking at criminal mischief charges. Is it worth it?

So a taxi driver wrote down your plate before when you admittedly cut him off, and now a street car driver blasted you for running an open door. What's the common theme here? Who else has had reason to complain to the cops about your driving?

Good drivers have nothing to fear about Roadwatch programs. Idiot drivers do.

A specific Roadwatch report may or may not result in a letter, visit, or charges being filed against you for that specific incident, but if the cops see you being the subject of multiple Roadwatch reports from different sources, they'll have a real good idea about who they should be keeping an eye out for. They'll also have a real good idea about who they shouldn't give you a roadside ticket break when they stop you for something.

Hell yeah, its not like they will put me on the lie detector. There are few people i dislike that i would be willing to go through all this trouble to actually lie to get them in trouble.

Though yes i do sound like an as$ but i got my reasons for it ;)

lets say there was someone behind Rick and he slammed on the brakes and ended up being rear ended or causing another type of accident, would the ttc driver be at fault or would rick? or would the person who rear ended him be 100% liable? I am actually curious.

The TTC driver would have nothing to do with it. The person who ran into the back of Rick would be at fault.

With respect to Rick and the streetcar, the doors will open only when the streetcar is stopped, and not when it is rolling along with the rest of traffic. A streetcar doesn't just suddenly stop without notice or for no reason.

If a streetcar is slowing almost to a stop, that should be clue to even a minimally-competent driver that the streetcar may be stopping to board or discharge passengers, especially if it happens to be doing so at an intersection. Simple common sense would have most drivers realize that they need to take extra care in passing a street car that has slowed to almost a stop.

I guess you missed the part where I typed that it was a red light therefore the street car was fully stop , however he was fully stop before I was even close to him.... I drove beside him because like i said he was fully stopped (doors close, no sign of somebody comming on the street car or off the street car) , its not like a drove 50km beside him , i could ve brake as soon as he open the door but like i said that would ve leave me right at the front door , therefore I drove 3 meters passed him to let the passengers come out

Again as per the taxi driver, you also missed the part in which he was honking at me like crazy and pretty much comming 2 inches from the rear bumper so that i turned right , however there were people crossing the street ( spadina and college )

I've had a situation like this, (somewhat, though I did not receive a ticket). Once when driving to work with my wife. I was supposedly tailgating a WheelTrans bus. (I think I was to an extent as I remember the driving going 75 in the fast lane on the 401, when traffic was moving very well beside and in front of him,. So obviously I noticed this, went into the lane beside him, and eventually passed and came in front of him.

The driver of the bus took my plate # down and called OPP. I got off at Yonge (which he reported). my work was about 2 mins from the exit, so I went to work and the wife took the car back home. Whilst she started traveling back home on the 401 (east) she was pulled over by the OPP who said the driver called about my car tailgating him. The officer could not give my wife a ticket as he directly identified the driver to be male. So long story short, she couldn't get the ticket, but the officer told her, had I been driving the car back, I would have received it.

At that point I don't know how a conviction could go through as both the officer and TTC driver would have to be there and corroborate their stories.

What part of stopped streetcars tend to board and discharge passengers did you miss? How would you be able to see someone IN the streetcar deciding to get off? If I come up to a streetcar stopped at an intersection, I literally crawl past any doors so that if they do open, I can stop instantly. Or I just wait behind the door. Common sense. Practice it.

Honking at you like crazy because (as you admitted) you cut him off? That sounds like you trying to deflect your bad act onto his bad reaction to your bad act. That makes both of you problem drivers.

From now on i ll just ignored your messages , it seems to me any thread you come into turns into an argument because you try to play the cop or try to play the " i m so perfect , i m always right" BS ....

I m this is not the first time as I remember not too long ago you also came into a different thread ( about some ticket )with your wanna be cop attitude ...

You may know a lot but to be honest i rather not see what you have to say , and i know many others may feel the sameway...

Anyways if someone else has some good info please share it ...

You shouldn't worry about this at all Rick. I've received 2 so far and nothing has happened. A civilian is not expected to know the law nor can they be judges of 'honest aggressive driving'. Police know that alot of people would call in just to make your life miserable if all you did was cut in, even if you had too.

Let me tell you bro if worse things come to happen and you get a ticket just fight it. Peel courts are PACKED with cases and the Prosecutor will always cut you a deal. I had three points shaved off a ticket for me. Pretty sure I told you that at the west end meet.

Never claimed to be perfect. I just don't make up excuses or try to blame someone else when I'm not.
