Thanks Insuranceman! So since my GF is paying her deductable now, do you think she'll get her money back eventually? I hope her insurance can get the money from the Budget's insurance company in West Virginia.

In theory yes, her company will pay for repairs if she has collision coverage on her vehicle - They will have to conatct the rental comapny and the insurer of the rental to confirm they have a valid policy and then send all the subrogation documents (estimate, rental bills, dec page to show the deductible) and request payment of the claim ... Depending on how uch they get back, she SHOULD get her ded back ... Ther First $1000 they get back has to be refunded to your g/f ... If they only get like $400 back, she gets it, no matter what ... They should get everything back, I can't see a rental company stiffing your g/f insurer ... unless they are disputing fault ...

Make sure you ask them who they are holding at fault

It is the other guys fault.

Unsafe lane change.

It was his responsibility to make sure the laneway was clear when he changed lanes.

If someone makes a lane change and an accident occurs, the person at fault is the person who made the lane change. Regardless if the impact was infront, behind, on the side.
Not true at all.
i know alot of people who got ****ed over this way. lane change means jack **** to them if there is no one to prove the distance etc... also what if the person did a proper lane change put the driver who was in that lane sped up? they determine this thru the type of impact worse comes to worse if both parties continue arguing they will just make it 50 50

They ususally look where the damage is as well to determine fault, a lot of the time you can tell who did what
