My advice: wear a nice suit, tell the prosecutor that you need your car for work when you arrive at the court and pray for a break. Don't expect the "I was passing" line to count for much but if you explain that the truck was constantly switching speeds and the change in speed limit that you missed it might make you look a little less reckless. Make sure you mention that you learned your lesson. You basically have to rely on the prosecutor or the judge deciding that it would serve the public interest better for you to keep your license (i.e. be able to keep your job) than to lose it (i.e. take a reckless driver off the road).

the transparent line ended near the bottom of the hill and i was back in my lane and off the throttle maybe if i explained it wasn't much of a hill on my side but it dropped off on the other side into a residential section!!!! anywhooooooo i got a good excuse for this and im hopeing to have it reduced or even tossed!!!!!!! i will divulge my story after my may 28th court date!!!!!!!!!!!!

A good excuse? Theres no such thing as an excuse in court. If you say "I was speeding because.... " then it doesn't matter what comes after because you just told the court that you were speeding and you just sealed your conviction. Excuses come under the heading of "guilty with an explanation" which is a whole lot different than "not guilty" and I'm sure one of the friendly people in the courtroom will remind you of that if your defence leans towards an explanation.

thats what i meant i have a good explanation for why i broke the law i admit i was speeding there is no if's and or buts about that i will just offer up my explanation and hope it helps me out i guess excuse was wrong choice of words

OK but make sure that if that is the line of explanation that you are going to produce in court then you have to plead "guilty with an explanation". If you plead "not guilty" and explain yourself then you will just be pissing the judge off and I think you need all the sympathy you can get.

I've seen successful businessmen stand up in court and make a fool of themselves trying to fight a speeding ticket. They were trying to give excuses and they all had 30 second trials. "Well your honour, I was going that speed because.... " "Oh so you were going that speed, guilty, next case". Just warning you, not judging you.

sorry for snapping on ya Kane haveing a ****ty go snapping on everyone!!!!!!!!!!! im hopeing for the best !!!!!! gona go in there tell them my story let it go from there im not planning on giving excuses or being rude just tell them what happened and pray for leiniancy (sp)

i can't afford representation they take my licence they take my licence i have almost 4000 in outstanding fines anyway i don't think they go to easy on me oh well at least i live close enough to walk to work!!! thanks for all of your advice!!!!!

ok...so it took u going 130 km/hr to pass a truck going 60 km/hr? please correct me if i'm wrong.
it doesnt seem like u have much of a case even if u do plead guilty with an explanation cuz there's no explaining why u would need to go 130 to pass someone going 60.

well first off when i jumped out to pass we were doing about 85 and i got booked doing 122 don't tell me anyone has never reached 120 passing someone when passing someone your under constant acceleration going from 85 to 125 or so is not a difficult thing nor is it difficult to not notice speed while passing when passing im more concerned with whats around me and completeing the pass in a safe manner thanks or your input

$4000 in fines? That figure implies an atrocious driving record. It also suggests that you don't learn easily.
The Crown will already have a transcript of your previous driving record. They can't (ordinarily) use it in court to prove that you're guilty of the current outstanding offence, but the Crown will use it to determine if they should give you a break via plea bargaining.
During trial, IF you somehow manage to fumble and claim you are a good and safe driver, you will have given them the opening to use your previous driving record in rebuttal to your claim of being a good and safe driver.
If you're convicted, they will use it to determine what your penalty will be. They won't be likely to impose a penalty at the low end of the scale for what you did.
