Angry what would you do/has this happend to you?

I was wondering if anybody has ever been in the same boat as me and what they did about it?

I had a shop (not mentioning names for legal reasons) do a b-series swap in my car last May. And now my tranny has a big chunk missing. I had the clutch done, by my trust worthy mechanic, a few months ago and he pointed out to me that one of the bolts were missing from the rear mount and that the holes didn't line up, but i figured if the shop who did the swap left it like this it must be ok, because what kind of shop would knowingly install something incorrectly?

So i confronted the shop who did the swap and they said that they weren't willing to do anything about it. I told them that all i wanted was a new tranny and the proper mount, which should have been used in the first place, and that i didn't want them to do any labour. I paid for the right parts but the right parts weren't used and now as a direct result of this my car can not be driven.

What would you do?

take them to small claims court and sue them... for the proper parts, then have your trust mechanic install it

I would suck it up and get the parts and have my trustworthy mechanic fix it up for me. Lesson learned and never return to that shop again, nor recommend anyone to go there.

People make mistakes and the important thing is to rectify it. As a buyer, you should also check the final product and examine the worksmenship before you paid and took the car away.

If the engine mount bolt was missing since day one, how come you didn't feel it after you picked it up?

good question. And how come this only happened now? The missing bolt is only part of the problem, the wrong mount was used so the holes don't line up.

tell them u want them to pay for ur parts and another mechanic to fix it for you or else your gonna call the better business bureau and then take them to court.
if u have it in writing what they agreed to do (ie. bseries swap) and it was not done to par, then u can take them to court for not providing the service they were paid to do

exact same thing happened to me just like a week ago, i had my car frame adjusted (it was bent) and wanted him to put on 2 new brade pads as well while he was adjusting the ****, so he put one new rotor on, kept the other new one and just tightened the old one that was on my other rotor. my rotor got fukked so my dad went back to the shop, b*tched at them and told them he wanted them to give him a new rotor and cash (my dads pretty big) so then the guy just gave my dad enuf to get the rotor and gave him $90 for compensation..
create a storm man. just go there and raise hell

thats it bud, take it elsewhere, get it fixed and go on...the time and hassle ur gonna go through with the other shop is gonna be retarded...this is why I dont reccommend certain shops to people...cough jpg exhaust cough lol

I told them that all i wanted was the right mount (which i paid for the first time but never received) and a new, not busted tranny.
so go there with a bunch of my big-a$$ friends and do the old intimidation trick? lol...yeah right.
And this is just the tip of the ice burg in terms of problems i have had with this shop. But i'm not going to get started with that.
I am looking for advice on this specific topic, because i don't really feel like spending $600-800 for a new tranny when it broke do to install error.

in the end its most likely gonna cost u more to get them to pay you out and or fix it...especially since it took you a year to figure out that there was a problem

be careful cynikal about bad mouthing business's on the internet (slander). I know you didn't in your post, but just be careful.
Its funny because that shop said if i go and put stuff on TCC and other boards that he would sue me for slander. So under no circumstances am i going to mention the name of the shop.
I am going to have to obviously pay out of pocket for the mount and tranny.
This is what happend. Where the casing is busted is where the bolt used to be. There should be another bolt just underneath that one, but there isn't, again because they used the wrong mount.

Unless you are gonna take them to small claims court...I suggest you just post up the name of there shop with a breakdown of what happened and just promote there bad worksmanship. Bad press will scare others away.

they cant sue you for slander for speaking your mind with an honest opinion...but when u get into calling them names and straight up bad mouthing them then there are problems...but then again they wont sue you cuz it costs too much...CTC wouldnt even sue me for what I said LOL

maybe u can find a cheap tranny casing and get a mount for cheap...and then u'd be set...the mount is a standard b-series mount no?

I remember the name of the shop that did your swap....they started using the board last year, just before you got your swap done.

Like has already been said...small claims court, a lesson learned.

Don't take this the wrong way, but its cases like this, that make me feel glad that I did my own swap. It took much more time, but I knew who was doing the work.

i kick myself in the a$$ everyday for not doing it myself and especially for taking to them.
Yes a 94-01 integra rear mount should have been used, but it wasn't.
I didn't think stating the facts on the internet was considered slander, but i don't need to get into legal issues here.

Slander occurs when you say untrue statements about someone in order to ruin their reputation. They would only have a case in court against you if they could prove what you are saying to be untrue, and that they observed a monetary loss as a direct result of your untrue statement.

Post the name away...lets warn others!!!

Wow the shop threatened u.........i woulda told them to go F themselves....and it'd be all over the net...every fourm board i know of around the GTA....

when it comes to something that i work hard for...i .e. my car....and someone screws up on it........they better fix it....if not....face the consequences of a bad rep...

post the name. . . or at least pm it to everyone!..lol
