small claims court

I'm planning to file someone that owes me $$$. The person use to live in Toronto, but now moved to California. So if i do file him, who is going to search for him? The small claims court will find someone to find this person if i have his first and last name and where he used to live? I need help thanx. What else do i have to bring to file this guy? Do i have to bring any evidence or receipt? I know u have to pay $75 to file a person and if u win the loser will have to pay for that. Someone hopefully have been through this so i can go and file asap thanx.

sorry to give you the bad news, but if he's in Cali now, your fuked, they are not going to do anything about it...they're basically not going to waste their time and tax payers money to find somone in the states for you especially small claims courts

believe it or not, say if theres a warrent out for you in Alberta and you live in Ontario, and you get pulled over and they run you and call in the station and tell them about the situation, most of the time they say that they just can afford to send two cops down to pick you up....the warrant will still be there, but you will be let go...

so, at the end of all this bullsihiting......if he's in California = your screwed

pretty much your screwed i believe. i was ****ed over on a deal from ebay but since the seller was in the us, i just let it go. if it was a canadian seller, i'd have pursued small claims.

Thanx for the advice. Could i even call the cops or call someone and find out all the information on where he lives now or find his # that i can reach him or something or is that personal that i can't get? Like find some RCMP or someone to help me. Anyways?

not at all.....sorry unless you lost thousands of dollars and your willing to hire a private investigator

no offence, but i dont' think anybody driving a civic has enough money to pay investigator for the 1000's of hours they're going to rack up trying to find this guy.....not worth it man

cops can't help, this is a civil matter not a criminal one. unless what he did was criminal ie. fraud or theft, its purely civil

You bought it off ebay you say? How did you pay - by Paypal? Ebay does insure most of it's transactions.

for me, it was paid by bidpay which is a money order, but both visa and bidpay are idiots, so i ended up just paying it. now i only use paypal or bidpay for vendors with like 9000+ positive feedback and low to no negatives.

Uh. yes I did, I was commenting on what alwaysoverkill was posting.

I didn't buy it from ebay. I brought it from this guy on torontocivics back in May and he was like yeah the car will be ready like next 2 weeks. So after 2 weeks later he said the car can't be sold and **** like that and then he will give me deposit. Now he went to live in California and he left me a cheque with no more cash in the bank since he already moved to California and his old place he lived in was rented. The guy use to work for performance auto sound. So any other ways i can get my $$$ back or i'm Fuc*ed most likely?
