Angry Small Claims Court

Here's the story.

I had wanted to pay my account off (FYI I do not have a contract as it expired and was month-to-month) because I am moving to Woodstock for school. I had missed two months (May and June) payments due to family health emergencies and other priorities.

I had gone into my gym on July19th and spoke to a manager-on-duty. I explained my situation and she decided to cancel all late fees and other charges

Side Fact>(I had not given them a new visa for direct payment and they had continuously wrang out the membership monthly fee. Although because the number had been canceled, they have been racking up NSF's. Which do not cause me any harm lol. Now I had spoken to the manager that I will come in to give them the new card number but never did, back in March. I told her in the interim to hold on the charges which she acknowledged)

so having all these charges waived the amount owing was 31.50 which I told her I would come in on July 31st to pay, which I did.

So now as I made that payment the clerk (which I have a good rapport with) explained to me that a memo stating that 'he is not to be excused from these charges and is required to pay another 62.90 plus $20 cover charge'.

I have been into this gym over 5 times during the day this month (it's 24/7 so I workout at night, too many females during the day and I don't want a dumbell to fall on myself because I am distracted...again) to speak with her and have all this rectified. Her schedule is Tuesday-Friday 9am to 3pm, yet she is NEVER THERE! I also keep getting the run around from this douche clerk posing as a manager telling me he books my appointments with her and when I arrive 'she just left'

So I am at a stand still. I have just google'd the company's email; as I could not find this managers, to contact me asap. I was told by the clerk to just not pay and have them goto collections which is a joke, yet will still effect my credit (which will kill me on OSAP). So I actually spoke to the police and was suggested to take it to small claims court. Which I plan on doing.


First off thank you for reading this story lol, but would like to ask for any advice, suggestions or responses to past experiences with gyms or a situation like this.

they might go to collections. collections won't come after you for a little bit.

if collections calls you, tell them not to contact you again unless it's by a lawyer as you don't owe them anything and they are welcome to sue you.

End of story.

If they want to pursue, they are legally obliged to get a lawyer.

They will not. Banks don't look at gyms putting hits on your credit because they understand a lot of them are BS and use this sort of activity as part of their business plan.

i'd say ask the bank if a gym sending you to collections will affect your credit... if it will, pay it.. if it won't it's up to you but i'd still pay it cuz it's only $80

This is the reason I don't join gyms. They're all scams. I just joined the community centre run by the city, and refuse to pay anything other than cash every month, after all, they need me not the other way around.
