You can't blame the cops, guys. He was treated no different than anybody else when he got pulled over. The arresting officer did his job. It's the JUDGE that let him walk. Our justice system is the *****!!!

just have a lawyer look up all the charges cops have gone to court and gotten off on, and try to use them as a precedent for your case.

at least there are some good officers out there.

from what i understand, they'll pretty much always let eachother off on speeding, but most of them will charge them if they've been drinking and driving.

The cop didn't get special treatment because he was a cop. He got off using the Carter defence, same as countless non-cops have also used over the past few years.

You provide reliable witness evidence that you weigh c kilograms, are of this sex or that, drank x amount of beers over y amount of time, throw in that you also consumed z amount of food. Then you get a toxicologist to offer his expert opinion that given all of that, you could not possibly have blown a reading of z and that the machine must therefore have given a faulty reading. That snake oil presentation might just throw enough reasonable doubt as to the accuracy of the breath test and without other evidence showing an accused was impaired, the charges might get thrown out.

Anyways, the laws pertaining to impaired driving changed just last week to remove that defence. Now the breathalyser machine is deemed to be accurate unless the defence can provide real tangible proof that the machine was in fact malfunctioning. The defence can no longer simply insinuate it as was the case when using the Carter defence.

On top of that, cops can now demand that you perform physical sobriety tests, and they can also routinely demand blood, urine and saliva samples for toxicology testing. Between all that, a breathalyser reading, plus the change in law supporting breathalyser reliability, the Carter defence will be all but dead for anyone charged with impaired from this week forward.
