Paypal - Have I been scammed?

I sell things on ebay very seldom, I had a product to sell recently which I listed on Ebay. There were a couple bids on the item which finally ended just over 600$. I sent the item Express to the buyer with insurance ( i wanted to cover it just in case), I kept good communication with the buyer finding out when he recieved it. After a couple days he got the item, he said he did receive it and has to try it out the next day. A week follows then i have a "dispute" on paypal, the claim is "not as described".

And the message says,
"Hello! Sorry, the burner is not working, the package was wet... And now, its not working... and now? best regards Markus Klages"

I then responded,
"You will have to cooperate with the post office. There was coverage and an investigation is in place. You will most likely have to send back the item. You will be contacted by your local post office. There is no need to put a hold on the money because this item IS as described."


But really I don't know what to do from this point on, does anyone have any recommendations?

I was thinking about ending communication and escalate this dispute to a claim with paypal. You are able to make a claim only 20 days after the dispute has been started. It would take longer than that to see if the insurance would go through with the post office.

I'm not sure what happens if you dont make a claim, or what side paypal would rule for.

don't wait for the person to do anything.

to hell with them.

go through paypal/ebay whatever to cover your own @ss and be done with it.

My question is, will paypal rule in my favor? Or will they say,"Shipping is your responsibility ect."

On the site it says after 20 days the funds will be available for withdrawal, So if he doesn't make a claim i keep it........

since you got insurance... you should be okay.. give paypal full details... and make sure you ignore whatever the guy says from now on.. don't give him any second chances... he might be trying to delay until it's too late.

as a seller, paypal is automatically not on your side.

make note and notify them of any inconsistencies.

check your spam to make sure you don't miss any emails from paypal as well

Should I email Paypal separately or make a "claim" ... As far as inconsistencies go the only one would be that he said he received the package a week ago and failed to mention that it was wet. Considering it was computer hardware most people would be concerned.
I am just concerned paypal may say that this is my problem and to issue a full refund.

you can also call paypal, and find out about more details and how to handle this situation, they are on phone support 24/7.

i have called them couple of times, and they are very helpful ppl imo.

I bought a CTR cluster from someone on TCC before, using PayPal for $380 I think it was. I sent the money, he never sent the item and I never heard from him again. I filed a claim with PayPal and they investigated it. Because I sent the money and didn't receive anything for it they ruled in favour of me. Similar to your case...you sent the item and never got paid. After the ruling they sent me $0.38, which was the total amount in this guys account, and an email saying that is all they can do. hahahah...as if! So, I called TD Visa and they gave me a fax number to fax them the emails between this guy and myself as well as the PayPal ones. A week later the credit for $380 was on my credit card. So, I recommend filing a claim with PayPal, if that doesn't work then call your credit card company, worked for me. Good luck man!

Had a similar situation when I sold my PS2 (fat one).
Buyer had the thing for almost 2weeks then claims it was DOA (dead on arrival).

He started a claim against me with a stop payment on PayPal at which point Ebay stepped in. Entire process from start to finish lasted about 1.5week. Ebay asked me via email to submit info re: the item, listing and shipping. After reviewing the case they determined that the item received was as described on the listing and ruled in my favour.

If you do start a claim make sure that your listing clearly indicates that when you sold the item it arrived in the SAME condition (IE. if listing says for working item should be working, if listing for broken/defective item, same part(s) are broken/defective when received). Unless beyond your control (fault of shipping company ie. fedex, ups, canada post).

Thanks, but the problem is it did not arrive in the same condition... but it was beyong my control.. but i'm afraid paypal will rule.. refund his money and make an insurance claim with the post office.. (it would have to be in my name)

Well you did say that he had the package for at least 1week before he said anything. I mean if you have proof (shipping receipt) that he had it in his possession for that amount of time before making any claims it will probably look better for you.

The only other way of getting your money now that I can see is small claims court but if he doesn't live in your area then the only way is through Ebay/PayPal claim.

Remember if you're telling the truth then you shouldn't have a problem when they do the investigation.
