Pulled over by a NEWB story...

Wussup people, the tradition continues



I got pulled over today in front of Markville Mall by a very young NEWB officer.

I am waiting to make a left onto hwy.7 at the lights at the swiss chalet/east side mario's Markville exit.

I notice a police car making a left into Markville at the same light.

He notices my car, and as I'm making my left turn I can see in my rear view mirror, the police car putting his cherries and siren on and making a U turn and swirving around the cars behind me just to get to me.

So I get pulled over just before mccowan.

The officer rushes out of his car and immediately comes to me and says "Your getting a ticket for Improper Muffler, open your hood!" The thing about this is that he didn't even ask me if he can check my hood, I know he has the right to, but he could have at least shown some respect. All other cops that pulled me over would always ask me, "Is it ok if I take a look under your hood?"

I pull the latch, and the officer is already in front of my car trying to open the hood without me doing it for him. I'm saying in my head WTF is this fool doing.

After opening my hood he points at my intake and says what's that? I say its an intake with a heatshield. He immediately says
"Do you know that intakes are illegal? You are not allowed to have that" I'm saying in my head, OMG, what a dumb *** NEWB cop!!

After that I try to close my hood, but realize that the cop messed up my hood, cause it can't close now, it doesn't close all the way now. I just left it and pleaded my innocence.

I told the officer that I've been pulled over many times already and they never said anything about my intake or exhaust being illegal. I also told him that I've recently passed emissions with both my intake and exhaust.

He then says, "Emissions doesn't have to do with anything with your muffler, if I were to rev my engine and you were to rev your engine your muffler would be obviously louder than mine".

I'm thinking in my head now, didn't he say to me that he's giving me an improper muffler ticket earlier? not an excessive noise ticket?

I also tell the officer that my exhaust is not loud at all because it has a silencer on it, I didn't even think he looked or even heard my exhaust.

The officer then says the famous line, "Any aftermarket muffler/exhaust with an aftermarket tip is illegal".

He finally takes my license and registration and goes to his car.

Less than a minute later, he comes back to me and says "I'm just giving you a warning, but you better watch out this summer because we'll be doing a big crack down", and he gives me a weird look.

I say, "Thanks officer, sorry about that" at that time I don't even no what I'm sorry for I was just saying in my head the whole time, what a newb cop! geese.

I'm glad I got out of it too, but in a way I was hoping to getting an improper muffler ticket so that I can go to court and fight it.

I need some practice for improper muffler tickets, lol.

thx for positive feedback.

P.s I took out the pic cause imagestation is messed up, does anyone know any good sites to upload pics?

Just want to state that, an officer has the right to search your vehicle because it is not a private place but a public place. If you refuse, be prepared to get arrested.

Your car isn't a public place, can anyone come into at any given time during the day...no, so therefore it is not a public place.
It is very much a private place, it belongs to you and no one else, you can say no, if you feels that they don't have a valid reason.
Even if he does have a reason say no anyway just to test him a little bit, he'll always give you one last chance to do it.

It is a public place in regards to police officers searching it. Citizens have no right for that. Officers have the right to search it and if you refuse you can be arrested.

Don't let me bust out the criminal code on your ***. Hell I should know, I'm majoring in criminology.

Just want to add... The officer obviously needs reasonable grounds to search... I.E ... Illegal modifications to the car.

Correction..

An officer has grounds if probable cause exists..

It didn't in this case..

my car is a public place?? I didn't realize that taxpayers bought me my car

as for the popping of the hood, I woulda asked "you pulled me over for the muffler, yes?" "yes" "well the muffler is back here" and I would have walked around to the back of the car, saying, "well then, good thing - cuz you have NO REASON to look under my hood. The muffler is in plain view from the back."

I'd rather get arrested than have pig prints under my hood.

Bruno is right, you don't have to pop your hood for a cop.
And they can't search your car just because they want to. I've refused both when stopped in my hatch, the cop appeared shocked that I did but then just forgot about it.
Other times I popped my hood and had the cop point at my small *** rad and say it's aftermarket.....right, a rad give me 100hp

At least you didn't get a ticket, I hate having to waste my time to get them either dropped totally or just knocked down in price.

Is this an on going discussion, jeeez ur car for one is not a public place.......thus u can refuse ppl to come into it............just like ur house is private property and if someone comes on to ur lawn....exculding side walks........u may tell them to screw off if u wish.

94EG6HB is correct in saying that an officer can only search if he has probable gounds.

& he/she the officer has to ask first...not demand......unless there was a reason for the demand.

PPL NEED TO READ THE LAW REALLY CAREFULLY!!!...READ SUBSECTIONS, AND DEFEINTIONS PERTAINING TO EACH SECTION NOT JUST THE FIRST DEFINITION IN THE BEGINNING OF THE ACTS AND OR REGULATIONS!

Idunno with how decaled up and visable my roll cage is (no tint) you'd think I'd get pulled over more .... must be the stock muffler I have

last time i got pulled over the cop thought my car was stolen cause the interior was out

actually at the time my window had 1000 cracks cause my hood flew up and was a bent out of shape.... he didn't even comment on that haha
