i'm getting screwed by warranty...need advice

basically i had a problem with my tranny so i took it to one of the recomended shops on the global warranty website and warranty people said the pump in my tranny was broken due to normal wear and tear and they won't cover it. my mechanic talked to them and nothing and i argued with them for a whole day and nothing. Now i have a 2700 tranny bill any advice?? i was thinking of getting a lawyer to write a demand letter but i'm not sure that will do anything and i don't want to throw away another $200 bucks

what are the terms of the warranty? you'll need to know that before you can decide whether you have a case or not.

global warranty meaning the warranty you received when you buy it at those little dealers??

man those warrantys are the worst. They wont cover anything , i remembered when i bought my jetta , 3 days after i bought it the shocks went on me , i took it back to the dealer and he told me to call the warranty , they said they will only cover it if my shocks completely broke. I told them they were gone. They asked me if the back of thecar fell on the road , so i told them not yet . They same guy told me we can only cover it if the back of the call fell on the road otherwise it is still working !!!

My friend had the same issue with his engine , one cylinder broke and the warranty people told him unless the other 3 break we wont cover it.

thats exactly what they are telling me unless something is physically broken they can't cover it. they are saying it's due to normal wear and tear which is bull. It's a 99 bmw 323i with 138km on it. It's not normal wear and tear. What happned to your friends did they pursue the matter? oh yea and the dealer i bought it from was markham mazda

well if you actually bought it at a mazda delaer it may be different . I am not sure about that.

My friend bought it a those little dealers that you can find in north york so they told him to speak to the warranty people that they had nothing to do with it . After calling the warranty numerous time and arguing with many people they decided to pay for 25% of the cost to fix it ( i m guessing 4 cylinders , 1 went so 25% ). At least they gave him something , but i remembered him calling them everyday and having a hard time to get that.

If you bought it at the official mazda dealer i would go there and speak to the person that sold me the car.

You have to read your warranty contract and see what exactly it covers. If it does not clearly state it will cover something like this, you are SOL. Basically because used car warranty is not the same as buying a new car.

problamz 18-Jan-2008 07:18 AM

i read the contract it says it covers it but it also says it does not cover wear and tear for such parts at piston rings things that raise oil pressure etc., but not limited to these parts so basically they can say that for everything.

It is the beauty of lawyer written materials, hard to interpret and grasp when it comes to wording.

Any wear and tear parts, to my knowledge, are not covered under warrenty. Things get used and old, that is our jobs to replace them. Manufacturer defects are covered, i.e. recalls.

Pyro 18-Jan-2008 10:55 AM

any ambiguities drawn up that are vague and open to interpretation will be used against the party that drew up the contract (aka in favour of you) so all you need is a good case to prove why it isn't normal wear and tear and if you take it to court you'll have a high chance of winning. Go seek legal advice though and don't quote me on that lol. i could be wrong (it's happened before)

pretty expensive **** man i hope you get it worked out.. i never filled out my BS warranty papers for the same reason. if my **** goes bust i'm upgrading

There Is No Way That Is Normal Wear And Tear!!!!

My friends dad has his tranny replaced on his 00 3-series and i had 170km...but that was becuase it was defective from the previous owner...the shop that replaced did not connect everything properly and so i died before it's time. i nearly took Honda to court becuase it cost me $3000 for them to discover that it was just a hole in the top of my gas tank that made my engine light keep comming on.
