sorry about your car, but generally if there is enough damage to set off the airbags then the chances are high that its a write off.

sorry to hear about your car man...
but as i can see from the pic it looks like a write off, just cuz your frame is probably damaged, plus i wrote off a car with less front end then that...

oh ya, if he was charged with a ticket and you were not... then he is at fault... and since it was a RED light ticket even better for you, cuz that puts him in the driver seat of the at fault train...

I'd have to agree with JSK on this one

there once was a time long time ago when I was in an accident... I rear ended someone those are easy to figure out because it's all my fault (not that I'm trying to dispute that)

call your insurance company.... it's not your fault if the other person was charged.

but as another note the insurance companies have a strict set of guidelines for determining fault with is leveled in 0 25 50 75 and 100 percent (at fault) amounts. I only wish I knew what legislation to look for cause then I'd look it up in your case... maybe insuranceman can help with this part?

Take your rims off and whatever is valuable...I dont like it when it is @ the pound for more than few hours..Anyways...as I see it...

Chances:
Win: If the dude does not show up for court date or something like that...and insurance is with you 100%..Make sure you get the witness name etc.

50/50: Most likely cuz you are both going threw a yellow or red light.

Lose: If you lose faith...

As for your car, I'd have to see it in person. I can't see where the dent is you're talking about. But if it's what i think it looks like, start looking for a new car. As for the parts, take off everything you can, and replace it with the factory stuff.





When I had my accident, I thought that from what I remembered seeing (before they put me into the ambulance), that my old car would have been fixable, (it looked ok from where I was.....boy, was I wrong...... it must have been the drugs they gave me. ).

After getting releasd from hospital, and then seeing the car a few days later.......I said....."yeah right, no way in hell".


I'm just glad I was wearing a seat belt, and the airbag went off.........or I might not be here. (knock on wood).

Thanks to those that helped me during the weeks that followed. You know who you are.

I will take all my stuff out tomorrow.

My friend was saying...after Insurance says it will be a write off...that they let you remove you're personal stuff from it...like rims and all aftermarket stuff...I guess that's not true?

Holy ****!! Sorry to hear it Sean... you car was soooo beautiful. I can't believe it :cry: Talk to your agent, see what he says. Generally, it's better not to claim it and just sell off parts from it, and put it towards a new car. Even if it's a writeoff. But if you can't afford to do that, then you're in a position of not having any other choice but to claim it, take like $9-10K that the insurance co gives you. Stip the car as much as you can before you claim it, like rims and whatnot... change it back to stock.

I'm going to have to disagree with you as well. I had a similar accident many years ago and both of us were charged. I was making the left (charged with unsafe turn) and she ran the red (charged with running a red). If you have not been charged as yet, you probably won't be, but insurance may still view this as an at-fault accident.

In any case, sorry to hear about your accident.
