Got in a car accident :-( Is my car a write off?

Got in a car accident :-( Is my car a write off?

So I was driving to work Saturday morning...waiting in the intersection of McCowan and Denison to make a left turn...the light turns yellow...the cars in the oncoming passing lane and left turn lane slow down and stop...so I proceed to turn left just as the light is about to turn red...and then this Honda Accord comes flying through the red light and hits me.

Everyone is telling me that it's my fault because I'm supposed to make sure all oncoming traffic has stopped before proceeding through the intersection...but...I don't know.

There was a witness, a very nice lady...she pulled over the ask if we were ok and to tell the cop what happened. She told the cop that the guy in the accord "flew by her to beat the light" ...he was given a ticket for running the red light. The cop asked me to write a report as to what happened and give it to her...I did. Now what?

Who's at fault here? I'm guessing and hoping it's him. When do I call my Insurance company? I haven't yet. Is my car a write off? The engine seems ok but the Rad and A/C are gone...the front end is gone...and my uncle says that the chassis is also bent...the roof looks like it buckled a little too.

NOt to sure, but it looks like it. A friend of mine was rear ended and plowed into the back of another car. The damage looked less than on yours, and the car was write off

I don't mean to say it but you're gonna be at fault for this accident. The person turning left doesn't have the right of way so you'll be at fault. You have to make sure all cars come to a stop before proceeding to turn left. I know it's not what you want to hear but your insurance company is gonna determine you are at fault.

You'll want to go to court for the ticket you'll be given.. probably Careless Driving or Improper Space When Making Left Turn. Get it fought and ask the judge to make a ruling that you were not at fault for this accident.

If you don't get your at fault removed off your record.. you're insurance is gonna be through the roof... much like mine did after my accident.

Sorry to see a good car got o waste!!:cry:

Did the officer say anything about you getting charged? You will most likely get charged with making an unsafe left turn because you are supposed to make sure all traffic is clear no matter how long iyou have to wait in the intersection. My friend was in a similar accident and that's what he got charged with.

Good luck and make sure you take it to court.

Since he was charged you might be lucky and not be at fault! If ins. tries to hold you at fault argue with them. Write everything like the officer said because you might need it sometime in the future and this way you will be able to re-account everything!

disagree with the comments regarding driver at fault..
the OTHER guy has already gotten a ticket for running a red, he's at fault
as said, GunMetal did use all due dilligence to ensure the way was clear before proceeding thru the intersection..he even has a witness that says the other idiot came out of nowhere with obvious intention of running the intersection..

Buddy got a red light ticket, thats a bad offence, hes screwed...

Sorry about your car, it almost brings a tear to my eye,:cry: was a nice clean coupe, looks like you spent some time and money with it.. I hate seeing that ****, it my worse nightmare

Charges have been laid.

1) GunMetal exercised all caution.
2) He checked to make sure the intersection was free from traffic.
3) The Light turns Amber
4) He checks again to make sure the intersection is free from traffic
5) The Light turns Red
6) He Enters the intersection with caution
7) A Honda Accord enters the intersection against the traffic lights and hits GunMetalsi

End of story.

You are not at fault

Feel Free to contact your insurance company anytime you want to.

Let them know the other driver has already been charged with fail to stop: red light

****, i just saw your car on friday night at boys toys.

call your insurance company and see what they say.

i'm no mechanic, but it looks like it could be salvageable.

to my knowledge if your air bag deploys the car is a write off regardless.

Bro, your rad support is messed up.. you dont want that car back anymore wont be same...

Show them as many receipts as you can and hope for the best.

My friend was t-boned by a lady that decided to pass 4 cars on the right and run the red in front of numerous cars, she was doing well over 80 km/h at the time of impact. There was numerous witnesses to say she should have stopped but accelerated to beat the light hitting my friends car. She hit with such force that the passenger seat where my other friend was sitting moved over to the drivers seat, if the passenger had been wearing a seat belt he would have been killed. After my buddy got out of the hospital after 3 weeks with a cracked sectum sp(a bone protecting the heart) the officers came to his house and gave him a ticket for unsafe left.

The driver of the cavalier was charged with running a red. They were later convicted of this charge. My friend hired a lawyer to fight and win his case.

Not trying to scare you but call the officer and see if they are planning on charging you and if you were at fault.

I know in the traffic act it says somewhere.


left turn is at fault. it does'nt make sense but the traffic act is messed up

Hey guys...thanks for the replies, I don't think this is my fault...JookSingKid explained it well...I was in the middle of the intersection when the light was green...it turned yellow, AND THE TWO CARS I COULD SEE SLOWED DOWN TO A STOP! ...so I proceeded through the intersection. Then WHILE THE LIGHT IS RED the accord comes flying through...I slam on my brakes and he swerves to the right and I crash into his side...that aside from the fact that...I CHECK THAT THE INTERSECTION WAS CLEAR while the LIGHT WAS RED!...

!...he got charged for running the red
!...the witness agrees to that
!...the cop said I won't be charged
!...the cop is on my side, she says she will compile the reports from me, herself, and the witness for the insurance company.

The witness and the cop believe I'm not at fault...only the insurance company will...How do I handle this? Can I really argue with them??? I guess I have to get the cop and witnesses reports to show them?

Ugh...my dad is calling the insurance company right now...

Anyways...back to my car...I'd like it to get written off since it will never be the same...the whole chassis is screwed...the roof doesn't have a wave in it...but where the roof touches the sunroof...there are two bends.

The traffic laws are all messed up.

I got into a tiny accident, involving someone that was speeding while I was making a U-Turn. I got a ticket and was said to be at fault.
