The cop probably didn't say sorry or anything because then it would be him admitting that it was his fault. Yes, it is obviously his fault since he slammed into you, but admitting fault isn't something you wanna do especially if you're a cop.

Ontario has no-fault insurance. The legislation behind Ontario's no-fault insurance severely limits what you can sue for in event of an accident.

The only way you'll get compensated through private civil lawsuit is if you suffer catastrophic injuries and after-effects. Even then awards are intended to cover long term medical costs, loss of income, and other out-of-pocket expenses. This isn't the USA; the awarding of heavy punitive damages in private civil lawsuits is not really part of Canada jurisprudence.

For simple bruising and minor cuts, even simple fractures, there is no significant out-of-pocket expense not already covered by your own car insurance, so you will get nothing by launching a law suit. Even if a judge does permit a case to go to trial, AND you manage to somehow win an award, legislation imposes a mandatory $30,000 deductable on any awards. So again, you will get nothing.

Duh, do you suppose that his division might already have a copy of the accident report? Do you really think the cop would just be able to get away with not returning the cruiser to his division?

And do you really think that there isn't a professional standards department separate from the individual police divisions, whose job it is to investigate such accidents involving police cruisers, and whose job it is to hand out "consequences" if need be?

Shocking I am sure. I witnessed one last weekend (end of January) and it was bad.

So you drove a Si, are you parting out engine? If so, please advice.

Hard evidence? Have you taken a look at the pictures?
That type of accident doesn't happen when people are paying attention. I would say that is more than enough evidence.

Why should it be any different because its the police?

The cop was following too closely, because he didn't have enough time to stop. (probably because he was chatting on his computer)

cops always get on my *** when they're following me... i think it's so that you can't see the lights on top of their car.

They apparantly do get into a lot of ish if they rear end someone though. Push it to the limits, but realize your actions may cause a fair bit of antimosity towards you.

the men in blue also tend to hold grugdes and look out for their fellow gang members.

good luck, and be glad you weren't hurt.

BTW: I was sued by someone and his wife for a car accident HE caused...

I don't know?!

I talked to the adjustor or whatever from insurance.... then it went to court... it disappeared from my record... I had won the court case anyway....

he sued me 8 monthes after the incidient... and then after he sued me, it wasn't a problem for my insurance all of a sudden.. so I guess he lost?

the adjustor was funny... I assume it's her job to find something that will let them say 'you're no longer covered due to...'

like she asked 'were you drinking the night of the accident?'

"Well, the police report said I was sober, so I wouldn't tell you if I was."

hahahaha

I don't think she liked me much... but I told her what to take pictures of and ish... the guy flew like 5 feet above the air in his car... hahaha

im bruised up and im a little stiff on my back/neck.. but thats about it...
Sometimes you don't feel the full effects of an injury until a few days after an accident. Make sure you go see a doctor and have everything documented. The longer it takes you to heal the more money you'll get. Insurance should cover stuff like physiotherapy treatments. Don't hesitate to use your benefits because you've paid for them. I hope you'll be alright and be more aggressive when negotiating your settlement. Good luck!

You don't only have to sue for physical damage to your body. Look at what a HUGE problem this is for you. Your god damned car is f@cked, therefore you have no means of transportation...thin of all the hard work, time, and money you spent on making it unique and how much that means to you. All those times you washed and waxed and the mint condition you kept your car in...all the pride...It's definitely worth something to you...just a thought.

my buddy did the same thing btw...wasnt watching the road and rammed into the back of a car, the same thing but far less damage and only the one c ar involved... the cop that showed up on the sceen raped him with tickets, following to closely, careless driving ect... Even if you dont sue him, make sure to follow up on the case and see to it that he pays all the proper fines associated with rear ending another car just like a civilian would pay if the roles were reversed.

Who lays the charges in cases like this? thats the person you gotta get in touch with.

this sucks..... what a hassle this thing is causing... im not seriously injured although my car is fully written off.... so im not even sure how much im gonna get from insurance for my car... things COULD have been worst if my car wasnt lowered.. that car wouldnt have gone up my hood and the accident coulda been worst... seems like the cop just screwed me over....

yeah he better get what he deserves... it aint fair if he's gonna get let off on this just because he's a police officer... the insurance knows we're frustrated about the whole thing and will let us know every single thing thats gonna be happening with the case..

upsetting...
one of my friends friend got into a serious accident where his car got written off as well... BUT.. he was injured where he had to go to physiotherapy and wear a neck brace.. received $300,000...:@
